By uploading your photographs, videos or any other materials (“Materials”), you are granting This Machine Filmworks, LLC and its successors, assigns, and licensees (“Us/Our”), the irrevocable, transferable, and sub-licensable right to use, edit and distribute your Materials in and in connection with our documentary about Mariah Carey in all media, throughout the world in perpetuity. You represent you have the sole right to grant Us the use of your Materials, and you will indemnify Us from any and all liability we incur if this is not true. You acknowledge and agree that no form of compensation or credit will be accorded to you for use of your Materials. You agree to release from liability, never sue, and bring no proceedings of any kind against Us in connection with Our use of your Materials. You irrevocably and unconditionally waive any right to seek injunctive relief, rescind these terms, or interfere with the production, promotion or exploitation of the documentary. You acknowledge that any Materials you submit will be considered non-confidential and we are under no obligation to keep them confidential. Submission of any Materials does not guarantee inclusion in the documentary. If requested by Us, you agree to promptly execute any additional documentation in connection with the Materials which shall be consistent with the foregoing terms.
